Supreme Scuttlebutt at the Texas Supreme Court

This was a joint presentation with Justice Willett to the Dallas Bar Association. The slides below represent my part of the presentation and exclude Justice Willett’s slides.

This part of the discussion covered:

  • the implications of the Court’s new calendar (in which all opinions are issued by early summer) for other parts of the petition review process – such as grants and the scheduling of oral argument;

  • my observations about how the Court’s practice has changed to fit the model set by SCOTUS, and what steps might logically be next;

  • the voting patterns among Justices, including the two who vote together more than any other over the past few terms; and

  • the interesting new trend of the Court affirming cases at a greater rate than the past.
